Terms and Conditions

1. Provider and scope
The provider is Julius Ziesmann, sole proprietorship, trading under QR ④ LIVE, Panoramastraße 22, 72144 Dußlingen, Germany (“Provider”). These Terms apply to the Alpha QR Code website and its online tools, and to downloading and using QR CODE ALPHA Desktop (“Services”). User terms apply only if expressly accepted by the Provider.
2. Services
The Services allow users to create, design, check, and export static QR codes. A static QR code directly contains the entered data; the Provider cannot subsequently change its destination. Current product descriptions determine available features, formats, and platforms. The Services are currently free. There is no entitlement to a particular feature set, uninterrupted availability, support, or permanent continuation of a free version.
3. Private and commercial use
QR codes created with the Services may be used, copied, printed, published, and incorporated into the user’s own products or advertising free of charge for private and commercial purposes. Users must hold all rights required for any content, logos, images, fonts, trademarks, and destination pages they use. The Provider claims no rights to user content or to the information encoded in a generated QR code. Third-party rights and the Provider’s rights in the website, software, design, marks, and supplied components remain unaffected.
4. Desktop licence
Users receive a non-exclusive right to use QR CODE ALPHA Desktop for its intended private or business purpose and may install it on their own or business-managed devices. Selling, renting, sublicensing, publicly providing or redistributing the application, removing notices, or circumventing technical protections is prohibited. Mandatory statutory rights, including legally permitted interoperability measures, remain unaffected.
5. User content and prohibited use
Users are solely responsible for entered data, generated QR codes, destination content, and distribution. Illegal, misleading, fraudulent, discriminatory, harmful, or rights-infringing content is prohibited. QR codes must not be used for phishing, malware, unlawful tracking, deception, or other abuse. The Provider does not generally review or adopt user content, but may restrict access when there is a concrete indication of misuse.
6. Readability and testing
Readability depends on size, contrast, error correction, material, print quality, lighting, distance, device, and scanning software. Preview and export therefore do not guarantee readability in every setting. Before publication, mass production, or costly printing, users must test codes with several suitable devices under realistic conditions and remain responsible for unchanged artwork and adequate quiet zones.
7. Third-party services
Codes may link to websites, messengers, maps, payment services, app stores, or other third-party offerings. The Provider does not control their availability, security, content, or terms. The respective operator’s terms and privacy information apply.
8. Availability and updates
Maintenance, security measures, technical failures, or events outside the Provider’s control may temporarily limit availability. Free features may be changed or discontinued for objective security, legal, compatibility, or development reasons. Security updates should be installed promptly.
9. Warranty
Mandatory statutory warranty rights apply. Where Services are supplied free of charge, the statutory standards for gratuitous services apply. A guarantee exists only when expressly identified as such.
10. Liability
Liability is unlimited for intent, gross negligence, injury to life, body or health, product liability, fraudulent concealment, and an expressly assumed guarantee. For slight negligence involving an essential contractual duty, liability is limited to the foreseeable damage typical for the contract. Liability for other slight negligence is excluded where legally permitted. The same applies to representatives and agents. The Provider is not responsible for user content, the legality of its use, later changes to external destinations, or third-party decisions unless the Provider is legally responsible for the relevant circumstance.
11. Privacy
Details are provided in the Privacy Policy. Users may include third-party personal data only where they have a valid legal basis.
12. Term and changes
Use of free online Services may be ended at any time. The desktop licence ends following a material breach; mandatory rights remain unaffected. Lawfully created QR codes may continue to be used unless third-party rights prevent this. The version incorporated when use begins or the application is downloaded generally applies. Changes do not apply retroactively without a legal basis.
13. German law, authoritative language, and disputes
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice does not remove mandatory protections of the country of habitual residence. Statutory places of jurisdiction remain unaffected.
German is the contract language and the German text is the legally authoritative version. This translation is non-binding; in case of differences the German text prevails to the extent legally permitted. The Provider is neither willing nor obliged to participate in dispute-resolution proceedings before a consumer arbitration board.
14. Final provision
If a provision is wholly or partly invalid, the remainder continues in accordance with section 306 of the German Civil Code; statutory provisions replace the invalid provision.
